Disclaimer:

(A) Agreement non-cancelable by advertiser and contains advertiser’s full and complete understanding of terms.
(B) Advertiser acknowledges upon signing of this agreement that he/she has read this agreement an has not relied upon any promise, statement of representation other than as contained therein and hereby acknowledges receipt of a copy of this agreement at time of approval.
(C) Final acceptance of this agreement shall be made in Riverside, California and Advertiser hereby waives notification of same.
(D) Proof will be completed for Advertiser’s approval prior to printing and changes must be returned by Advertiser to Joel Snyder (Publisher) within 48 hours. Proofs not returned within 48 hours, or by the changes cutoff dates are considered to be approved and will be published as completed.
(E) Upon failure of Advertiser to pay the amount agreed upon, at the option of Publisher, the space contracted for may not be produced. Advertiser agrees to forfeit any claims to refunds or future ad space available. All reasonable attorney fees and other collection costs incurred by Publisher collecting amounts past due shall be paid by Advertiser. Advertiser agrees to the sole responsibility of approving the ad proofs, initial deposits will be used to process, design, layout and paste-up proofs for Advertiser, therefore no refunds shall be made, advertiser also agrees to pay all NSF fees incurred by publisher due to return checks. Advertiser agrees also to pay 10% interest charge per annum on all past due balances.
(F) Parties hereby agree that this agreement shall be interpreted in accordance with the Laws of the State of California and in the event of any legal disputes arising out of the terms of this agreement, venue shall be in the State of California, County of Riverside.
(G) Advertiser agrees that the liability of Publisher, if any, for any omissions, mistakes, errors and/or defects in said advertisement shall in no event exceed the cost of space occupied by the error, but not exceeding the amount of advertising fees actually paid by Advertiser to Publisher. In the event of error, Publisher shall have the option to reprint the advertising in the next issue or refund any fee or portions of fees paid.
FORCE MAJEURE: Publisher shall not be liable for failure to print if failure is caused by labor dispute, strikes, war, fire, flood, accident, paper or other material shortages: or any act of God.  In such cases, Publisher may extend the time for completion of agreement or credit a pro rate amount to advertiser.
(H) Publisher makes no allowances for the delivery performance of the US Postal Service. Once the shipment has been received by the
Postmaster, all liabilities or considerations are between the advertiser and the Postmaster.
